Industrial design is an overall
appearance of a product or article. Industrial process means the features in
the finished product give it unique appearance.
Patent is based on a
“first-to-file” rule basis; filing should be made before an article is
disclosed to the public. Prior disclosure will destroy the novelty of the
design.
File an application for the
registration of an industrial design?
1. Industrial Filing: country
basis (apply directly to the relevant countries or ii) filing use the Paris
convention members countries.
2. Formality & Examination:
Checking with Industrial design application complies with all the formal
requirements
3. Novelty Search: Registrar will
publish it in Official Gazette for Industrial Design, for period of three
months as of the date of receipt.
4. Certification of Registration:
Publication with no opposition or objection than your application is being
accepts by government authority.
A registered industrial design is
given an initial protection period of 5 years from the date of filing and is
renewable for a further two consecutive terms of 5 years each.
