Korean trademark registration has become one of the most essential way to conduct business and the most popular way to protect intellectual property, as Korean is a vigorous developed economy in Asia even around the world. In South Korea, registration is compulsory in order to be granted rights to a trademark, as this jurisdiction is “first-to-file”. Foreigners must perform the trademark prosecution in South Korea through a registered Korean patent attorney.
Registerable Marks
A trademark in Korea may consist of a symbol, character, diagram, three-dimensional shape, or any combination thereof, color combinations, hologram, movement or other item that can be visually recognized, any sound, odor or others that expressed realistically with a sign, letter, figure, or by any other visual means among sounds, odors and others that cannot be recognized visually.

Application Procedure for Korean Trademark
The whole processing time from the first start to the registration is about 12-18 months, on the condition of smooth application with no objections or oppositions. The process includes: a formal examination, an examination of distinctiveness and a search for prior conflicting trademarks, publication, and registration. If an opposition occurs, it will last 2 months from the date of publication of the trademark application.
Validity and Renewal
The trademark registration in South Korea is valid for ten years from the date of registration of a trademark. A trademark in South Korea may be renewed an unlimited number of times every ten years. To renew the term of registered trademark rights, an applicant should file an application to renew the term within one year before its expiration date. Renewal of a trademark in South Korea after the renewal due date is allowed within six months only.
One registered Korean trademark is required to be used within 3 years from the date of registration; otherwise, it may be subject to cancellation.
