trademark is a way for one party to distinguish themselves from another. In the
business world, a trademark provides a product or organization with an identity
which cannot be imitated by its competitors. A trademark can be a name, word,
phrase, logo, symbol, design, image, sound, shape, signature or any combination
of these elements. The procedures for US trademark registration are described
as below.
I. Importance
of US Trademark Registration
A US trademark registration will give you with the
exclusive right to use your trademark in the US on the categories of products
and services for which it is registered for a period of 10 years with the right
to renew thereafter.
Only trademark registration will give this exclusive
legal right. Company name registration and domain name registration, whilst
important, do not confer any legal exclusivity to use the trademark or prevent
others from using your trademark.

others from using your trademark quickly and cost-effectively. You will protect
your business, its goodwill and reputation and enhance its value to potential
buyers and investors. What is more, you are also able to protect your trademark
throughout all of the Member States of the European Union as a Community Trade
Mark with just one application.
II. US
Trademark Search
Before filing your application, please find out whether
or not that trademark is already being used for the type of product or service
that you wish to use it for.

III. Submit
Application of US Trademark
An application must include the following documents
before the US Trademark Office will accept it.
(1) Authorization letter of registration;
(2) Qualification certificate of applicant;
(3) A clear drawing of the trademark;
(4) A listing of the goods or services;
(5) The filing fee for at least one class of goods or
services.
IV. Notice of
Acceptance
When The US Trademark Office receives your application
data of trademark registration, they will give you an application number and
issue the Notice of Acceptance within 3 months.
V. US Trademark
Examination
After the US Trademark Office determines that you have
met the minimum filing requirements, the application is forwarded to an
examining attorney. This may take a number of months. The examining attorney
reviews the application to determine whether it complies with all applicable
rules and statutes and includes all required fees.
A complete examination includes a search for conflicting
marks, and an examination of the written application, the drawing, and any
specimen.
VI. US
Trademark Publication
If the examining attorney raises no objections to
registration, or if the applicant overcomes all objections, the examining
attorney will approve the mark for publication in the Official Gazette, which
is three months publication of the US Trademark Office.
VII. US
Trademark Registration
If no party files an opposition or requests to extend the
time to oppose, the US Trademark Office will normally register the mark and
issue a registration certificate. The date of filing the application will be
the registration date.
VIII.
Time-frame
Time: The approximate time for obtaining the certificate
is about 8-12 months for smooth application. The term of validity is 10 years
from the date of filing the application, in which period no extra fee is
imposed.
