What is Intellectual
Property?
Intellectual
property, which is the intangible property created by human wisdom, including
trademarks, patents, copyrights, industrial design and so on. I believe many
people are unfamiliar with the word intellectual property. The most valuable
thing about a company is its name and brand. Don't ignore this matter on the
road to start a business. Any person or business can apply for registration
with the Malaysian Intellectual Property Office (MYIPO) through Tannet
Malaysia.
Intellectual Property
1. Trademark
Trademarks
are the most common type of intellectual property. Trademarks represent the
brand of a company, and most are used to distinguish the differences between
others. It can be a personal or business name, or it can be creative text plus
graphics, and generally has significant features to appeal to the public. A
trademark that has been successfully registered, except for the owner and the
authorized person, may not be used by others or the company, and the abuser may
be dealt with by the infringement action. The period of protection is 10 years
and can be updated for 10 years at a time. The owner of the mark or service
mark may use or transfer or authorize others to use the mark or service mark.
2. Patent
Patents
refer to inventions created by law, including invention patents, utility model
patents and design patents. The mobile APP or computer software we use every
day may be a patent of a company. The patent law stipulates that the patent
protection period is 20 years, counting from the filing date. According to the
law, the certificate can provide initial protection for ten years. From the
date of filing the application, the protection period can be updated for two
consecutive periods, each period of five years, but must be used.
3. Copyright
It
refers to the rights of authors of literary, artistic, and scientific works to
their works. The period of protection of literary, musical or artistic works is
the author's lifetime, plus 50 years after the author's death. The period of
protection for recording, broadcasting and film is 50 years after the
publication or production of the book.
4. Industrial Design
An
industrial design consists of features of shape, configuration, pattern or
ornament applied to an article by any industrial process or means, being
features which, in the finished article appeal to and are judged by the eye. An
article means any article of manufacture or handicraft, and includes any part
of an article that is made and sold separately.Examples of articles the designs
of which are registrable include furniture, toys, mobile telephones, electronic
gadgets and appliances, household utensils, bottles, cases, carpets, wallpaper
and textiles.
An
industrial design that meets the above definition qualifies for protection
provided:
-it
is not contrary to public order or morality; and
-it
is "new".
The
initial registration lasts for a period of five years from the filing date of
the application. The period of registration may be extended for two further
consecutive terms of five years each on payment of the prescribed official
fees, for a total period of protection of fifteen years.
