Russia trademark are registered
by the Russian Federal service for intellectual property (Rospatent) “the
Russian Trademark Office” as per requirements and procedure set by the Civil
Code of the Russian Federation and Rules of drawing, filing and consideration
of trademark and service mark applications.
Russia Logo Registration Required Document
The following documents shall be
provided to the Russian Trademark Office for Russia Logo Registration:
·
a power of attorney authorizing a patent attorney to act on behalf of
an applicant;
·
a print of trademark;
·
a list of goods and services to be covered by a trademark (grouped
according to the Nice Classification)
·
a name of an applicant (in accordance with the foundation documents of
a company);
·
a legal address of an applicant (in accordance with the foundation
documents of a company);
·
Contact details of an applicant.
Russia Logo Registration Procedure
After completion of filing
procedure the official notification of the receipt of the Application is issued
within 3-5 months. Then the trademark undergoes substantive examination for
about 9–16 months. On condition that the trademark meets the requirements of
protect ability the grant decision is issued. After payment of the registration
fee the certificate of registration is issued within 2-4 months. The procedure
of the trademark registration takes from 14 to 19 months. The trademark will be
published within 7 months form the date of registration and after the
certificate is issued. There is no opposition provision in the law but any
interested party can file a cancellation action against any registration during
5 years from the date of publication.
Term of Russia Trademark Protection
The term of Russia trademark
protection is 10 years from the date of registration. The Russia trademark may be renewed for
additional ten year terms within six months of the expiration date of the
mark's present term.
