Belgium
trademark registration is the first step for business owners in Belgium.
Business owners must take design a sign that will serve as a trademark for
their company. In principle, any signs can be considered trademarks. They can
include words, images, colors, shapes and even sounds. The trademark must be
associated with specific products or services, thus the entrepreneurs must also
decide for which products he or she will register the trademark.
Belgium Trademark Registration Requirements
A
Belgium trademark application has to be filed before The Belgian Office for
Intellectual Property (OPRI). A Power of Attorney is not required. Foreign
applicants do not need a domestic registration.
Belgium Trademark Procedure
The
Belgium trademark application process includes an examination on absolute
grounds; the official search has been abandoned. Signs not deemed distinctive
in the examination can be registered if distinctiveness has been acquired by
use.
After
the examination on formalities and absolute grounds, the application is
published in the online Benelux Bulletin for opposition purposes. Oppositions
could be filed within a period of 2 months after the first day of the month
which follows the date of publication of the mark.
The
whole procedure takes between 5 and 8 months if there are no complications.
There also exists an expedited registration procedure.

Protection
A
Belgium trademark registration in The Belgian Office for Intellectual Property
(OPRI) is valid for 10 years from application date. The registration is
renewable for periods of 10 years.
