Portugal Trademark Registration- Portugal is a member of the Madrid Agreement, the Madrid Protocol and the European Union. In Portugal the legal basis is the "Industrial Property Law" and the "Decree Law 143/2008" of July 25th, 2008. Portuguese trademarks are also protected on the Azores and Madeira and Trademark protection is obtained by registration. Portugal Trademark Registration Filing Requirements:

- Power of Attorney (in Portuguese or with verified Portuguese translation)

- Copy of the Commercial Register or Certificate of Incorporation (in Portuguese or with verified Portuguese translation)

- Logo in JPEG format.

- The full particulars of the applicant

- The list of the goods and/or services to be covered by the trademark and classes

- Priority document with verified Portuguese translation


Procedure of Portugal Trademark Registration

The Portugal application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks. It takes approximately 6-8 months from first filing to registration. Before registration the trademark application is published in the Portuguese Industrial Property Gazette for opposition purposes. When the Portugal opposition phase comes to an end (or an opposition is filed) the application is submitted to an examination. Afterwards, the final notification is issued. The registration of the trademark is published as well. The opposition period is 2 months from publication of the Portugal opposition, extendable for an additional month. After the end of said term, late Portugal oppositions will not be accepted.


Duration of Portugal Trademark Registration

Once your Portugal trademark has been accepted, and presuming no third party objects to your registration during the standard three month opposition period, your logo will be registered for a period of ten years from the date of filing. The Portugal Trademark registration is renewable for periods of 10 years.
