Spain Trademark registration - Spain is a member of the
Madrid Agreement, the Madrid Protocol and the European Union. Spanish
trademarks are protected in the continental territory as well as on the
Balearic Islands, the Canary Islands and the territories of Ceuta and Melilla
in Northern Africa. Trademark protection is obtained by registration.
Requirements of
Spain Trademark registration
A trademark application has to be filed before the Patent
Office in Madrid by a local agent. A non-legalized power of attorney is
sufficient. Foreign applicants do not need a domestic registration.
Procedure of Spain
Trademark registration
The Spain trademark application process includes a formal
examination, as well as a substantive examination on absolut grounds for
refusal. It takes approximately 6 months from first filing to registration.
Before registration the Spain trademark application is published in the
“Boletin Oficial de la Propiedad Industrial”, issued daily. The opposition
period is 2 months from publication date of the application.
Duration of Spain
Trademark registration
A Spain trademark registration is valid for 10 years from
the application date. The registration is renewable for a periods of 10 years.
