trademark can be protected either through the country's regulations, either through
international laws. In Poland, trademark protection is granted by the Polish
Patent Office. Due to Poland's membership in the European Union, Community
trademarks registered at the Office for Harmonization in the Internal Market
(OHIM) in Alicante are also valid in Poland and protected throughout the
European Union. International registration can be made in Geneva, at the
International Bureau of World Intellectual Property Organization (WIPO).
Registrable Poland Trademark
Signs
registered as Poland trademarks must have certain features that distinguish
them from existing ones. Any graphic sign or a sign than can be represented
graphically can be registered as a registrable Poland trademark are:
- Words;
- Designs;
- Ornaments or combinations of colors;
- Three-dimensional shape of goods or their packaging;
- Melodies or other acoustic signals.

registration: Procedure
The Poland application process includes a formal
examination, an examination of distinctiveness and a search for prior
trademarks. It takes approximately 2 years from first filing to registration.
After registration, the trademark is published in the monthly “Wiadomosci
Urzedu Patentowego”. An opposition may be filed only after the registration has
been granted. The opposition period is 6 months from the publication date of
the registration in the ‘Wiadomosci Urzedu Patentowego’.
Duration of Poland Trademark
Once
the Poland trademark is registered, it is valid for 10 years starts with
registration date. The registration is renewable for periods of 10 years.
