Taiwan Logo must file a Taiwan Logo application with Taiwan's
Intellectual Property Office (TIPO).
Taiwan Logo Class selection
Taiwan Logo classes are commonly referred to as classification of goods
and services. It is a standard way to describe and organize the types of goods
and services to which the marks apply. The Nice Classification of Goods and
Services is an international standard adopted by 148 countries. Though Taiwan
is not a signatory to international Logo treaties, Taiwan is a member of the
World Trade Organization (WTO), and it follows the Nice Classification system.
Taiwan Logo Search
During the TIPO examination procedure, there is no interiorities
research is done. As the application of a Logo in Taiwan is considered as an
act of infringement, therefore it is important to conduct a Logo search before
filing the Taiwan Logo application.
Taiwan Logo Application
Normally, the TIPO renders a decision within six months after it
receives all supporting documents. If
the application is approved, the mark will be published and registered after
the applicant
Taiwan Logo Filing
The Taiwan Logo application has to contain the applicant
identification, the Logo, the product(s) and/or service(s) to which it applies
and, when it occurs, the claim of a foreign application priority.
Taiwan Logo Application Publication
The Taiwan Logo application is published in the Taiwan's Intellectual
Property Office (TIPO) within about 6 to 7 weeks working days of the filing
date.
Taiwan Logo Examination
The Taiwan Office may ask to specify the designated products or to
include a class which contains some of the designated products, without extending
the application scope. The Taiwan's Intellectual Property Office (TIPO) may
also refuse a sign for its lack of distinctively.
In case of irregularities, the applicant has a time allowed by the
Taiwan's Intellectual Property Office (TIPO) (generally one month) in order to
regularize his application or to contest the observation.
Term of Taiwan Logo Protection
The
term of Taiwan Logo protection is ten years start from the date of registration. The Logo may be renewed for additional ten
year terms within six months of the expiration date of the mark's present term.
